Withdrawal, returns and refunds

This English translation is provided for your convenience. In case of any discrepancy between the Italian and the English version, the Italian version prevails.

Right of withdrawal

The right of withdrawal is reserved for consumers, i.e. natural persons purchasing for purposes outside their business or professional activity.

The consumer may withdraw from the purchase within 14 days of delivery, without having to give any reason.

If a single order is delivered at different times, the period runs from the delivery of the last product, lot or piece.

The right of withdrawal does not apply to purchases made by businesses or professionals for professional purposes, unless otherwise agreed in writing.

How to notify withdrawal

The consumer can notify withdrawal:

• using the online function “Withdraw from the contract here”;
• by sending an explicit statement to info@fx4.it;
• using the model withdrawal form.

The notice must include at least:

• first name and surname;
• email address used for the order;
• order number;
• products concerned;
• explicit wish to withdraw from the purchase.

The online function allows the contract to be identified, the withdrawal to be confirmed and a receipt containing the request, date and time to be sent immediately to the customer.

Return of products

After notifying the withdrawal, the consumer must return the products within 14 days to:

The direct costs of returning the goods are borne by the customer.

The customer is asked to use:

• suitable packaging;
• a tracked shipping service;
• protection suited to the nature and dimensions of the product.

For tubes, profiles, heavy or bulky products that cannot be returned by normal post, the cost depends on the weight, length, destination and carrier chosen.

Condition of the returned product

The consumer may examine the product only to the extent necessary to establish its nature, characteristics and functioning.

The consumer is liable for any diminished value resulting from handling beyond what is necessary.

The absence of the original packaging does not automatically entail the loss of the right of withdrawal, but may affect the assessment of any diminished value.

Refund

In the event of a valid withdrawal, ATD S.R.L. refunds:

• the price of the returned products;
• the cost of the initial standard shipping.

Additional costs resulting from the choice of a different or more expensive delivery than the standard shipping offered by FX4.it are not refunded.

The refund is made using the same means of payment used for the purchase, unless otherwise agreed with the customer.

The refund is issued within 14 days of the notification of withdrawal. ATD S.R.L. may withhold it until it has received the products or until proof of their dispatch has been provided.

Customised and cut-to-size products

The right of withdrawal does not apply to products:

• made according to sizes entered individually by the customer;
• clearly personalised;
• specifically cut to individual specifications;
• modified according to instructions provided by the customer.

The exclusion does not automatically apply to normal standard lengths or configurations already available in the catalogue.

The guarantee always remains applicable when the product is defective, damaged, non-conforming or cut to a size different from the one ordered. The exclusion from withdrawal for goods made to the consumer’s specifications or clearly personalised is provided for by Article 59 of the Italian Consumer Code (Legislative Decree 206/2005).

Damaged or non-conforming products

Returning a defective, incorrect or non-conforming product does not constitute a normal withdrawal.

In these cases the customer must contact:

stating:

• order number;
• product concerned;
• description of the problem;
• available photographs or videos.

The costs of handling products recognised as defective or non-conforming are not borne by the consumer.
