1. Identity of the seller

2. Scope of application

These General Terms and Conditions govern purchases made on the FX4.it website by:

• consumers, i.e. natural persons purchasing for purposes outside their business or professional activity;
• professionals and businesses, i.e. parties purchasing in the course of their economic or professional activity.

Provisions expressly reserved for consumers do not apply to purchases made for professional purposes.

In the event of conflict, the mandatory rules protecting consumers prevail over these Terms and Conditions.

3. Sales territory

FX4.it accepts orders for delivery exclusively within Italian territory.

The possible availability of the website in English does not imply the acceptance of orders for delivery abroad.

4. Product information

The main characteristics of the products are indicated on their respective product pages.

Photographs are for illustrative purposes. Colours, finishes and non-essential details may differ slightly from the actual product, without affecting its characteristics, functionality or conformity.

Before ordering, the customer must check:

• sizes;
• diameter;
• thickness;
• length;
• compatibility;
• quantity;
• material;
• any technical warnings.

5. Availability

Products can only be ordered when they are shown as available.

Adding a product to the cart does not reserve it.

If, due to an inventory error or simultaneous orders, a product turns out to be unavailable after the order has been sent, ATD S.R.L. will inform the customer and refund in full any amount already paid.

6. Customised and cut-to-size products

Some products, including tubes and profiles, can be cut to sizes specified individually by the customer.

Before the order is confirmed, the following must be shown:

• requested size;
• price;
• any processing cost;
• shipping cost;
• expected preparation time.

The customer is responsible for the accuracy of the sizes entered.

Once processing has started, the order may be changed or cancelled only with the prior acceptance of ATD S.R.L.

The guarantee always remains applicable if the product is:

• defective;
• non-conforming;
• damaged;
• cut to a size different from the one ordered.

7. Purchase procedure

To place an order, the customer must:

1. select the products;
2. add them to the cart;
3. check quantities, characteristics and sizes;
4. enter billing and delivery details;
5. select shipping and payment;
6. read these Terms and Conditions;
7. confirm the order using the button that entails an obligation to pay.

Before sending the order, the customer can correct any errors.

The automatic acknowledgement of the order confirms that it has been registered by the system, but does not necessarily constitute final acceptance.

The contract is deemed concluded when ATD S.R.L. sends confirmation of acceptance or shipment of the order.

8. Prices

Unless otherwise indicated, prices for consumers are expressed in euros and include VAT.

Before the order is sent, the following are shown:

• price of the products;
• VAT;
• any discounts;
• shipping costs;
• any processing;
• total amount due.

Information on the total price, additional costs, delivery and the right of withdrawal must be made available before the consumer is bound by the order.

9. Shipping costs

Shipping by express courier costs €9.90 VAT included for the first item, plus €2.00 VAT included for each additional item in the same order.

Example: an order of 3 items pays €9.90 + €2.00 + €2.00 = €13.90 for shipping.

There is no free shipping threshold: the cost applies to all orders, whatever the amount.

The shipping cost is always shown in the cart and at checkout before the order is confirmed.

10. Payment methods

Depending on the order, the following are available:

• credit or debit card;
• PayPal;
• bank transfer.

Cash on delivery is not accepted.

Bank transfer

The order is processed once the payment has actually been credited.

Payment must be received within 3 working days of order confirmation. Otherwise, ATD S.R.L. may cancel the order.

Product availability is definitively verified when the payment is credited.

11. Preparation and delivery

For standard products in stock, the ordinary preparation time is approximately 24 hours on working days, subject to availability.

Once the goods have been handed over to the courier, delivery ordinarily takes place within 1-2 working days.

Longer times may be required for:

• minor islands;
• remote or hard-to-reach areas;
• bulky products;
• customised products;
• cut-to-size products;
• public holidays;
• causes not attributable to ATD S.R.L.

The specific time for customised products is indicated on the product page or before the order is confirmed.

Unless otherwise agreed, delivery to the consumer must in any case take place without undue delay and no later than thirty days from the conclusion of the contract.

12. Couriers

Delivery may be entrusted to one of the available carriers, selected on the basis of:

• destination;
• weight;
• dimensions;
• nature of the products;
• level of service requested.

The courier and the tracking code are communicated after shipment, where available.

13. Checking the delivery

On delivery, the customer is asked to check:

• number of packages;
• integrity of the packaging;
• absence of openings, crushing or damage;
• apparent correspondence of the goods.

If there is visible damage, it is advisable to accept the parcel with a specific reservation, describing the damage found.

Failure to make a reservation does not remove the mandatory rights granted to the consumer by the legal guarantee.

14. Consumer’s right of withdrawal

The consumer may withdraw from the purchase within 14 days of delivery, without giving any reason, subject to the exclusions provided for by law.

Withdrawal may be notified:

• through the online function “Withdraw from the contract here” available on the website;
• by sending an explicit statement to info@fx4.it;
• by using the model withdrawal form published on the website.

The online function must remain accessible throughout the withdrawal period and must send the consumer a confirmation containing the date, time and content of the request.

15. Return of products

After notifying the withdrawal, the consumer must return the products within 14 days to:

The direct costs of returning the goods are borne by the customer.

For goods which, by their dimensions or nature, cannot be returned by normal post, the cost will depend on the carrier chosen and the characteristics of the shipment.

The customer is asked to use suitable packaging and a tracked service.

16. Condition of returned products

The consumer may examine the product to the extent necessary to establish its nature, characteristics and functioning.

The consumer is liable for any diminished value resulting from handling beyond what is necessary.

The absence of the original packaging does not automatically entail the loss of the right of withdrawal, but may be taken into account when assessing any diminished value.

17. Refund

In the event of a valid withdrawal, ATD S.R.L. refunds:

• the price of the returned products;
• the cost of the initial standard delivery.

Additional costs resulting from the choice of a delivery service more expensive than the standard option are not refunded.

The refund is made using the same means of payment used for the purchase, unless otherwise agreed.

ATD S.R.L. may withhold the refund until it has received the goods or until proof of their dispatch has been provided.

18. Exclusions from the right of withdrawal

The right of withdrawal does not apply to goods:

• made to the consumer’s specifications;
• clearly personalised;
• cut to a size individually entered by the customer;
• specifically modified according to the customer’s instructions.

The exclusion is not automatically applied to products available in standard lengths or configurations already listed in the catalogue.

The exclusion for goods made to the consumer’s specifications or clearly personalised is provided for by Article 59 of the Italian Consumer Code (Legislative Decree 206/2005).

The right of withdrawal does not apply to purchases made by businesses or professionals, unless otherwise agreed in writing.

19. Legal guarantee for consumers

New products purchased by the consumer are covered by the legal guarantee of conformity for two years from delivery.

In the event of a lack of conformity, the consumer is entitled, in the cases provided for by law:

1. to repair or replacement free of charge;
2. to a proportionate reduction in the price;
3. to termination of the contract.

The consumer must contact ATD S.R.L. directly by writing to info@fx4.it and stating:

• order number;
• product;
• description of the problem;
• any useful photographs or videos.

The guarantee does not cover damage caused by improper use, incorrect assembly not attributable to the instructions, normal wear and tear, inadequate maintenance or modifications made by the customer. The two-year duration and the primary and secondary remedies are summarised by the Italian Ministry of Enterprises and Made in Italy (MIMIT).

20. Guarantee for business customers

Purchases made by professionals or businesses are subject to the provisions on the warranty against defects laid down in the Italian Civil Code, unless specific conditions have been agreed in writing.

21. Complaints and assistance

Complaints, requests for assistance, returns and reports can be sent to:

The message must include the order number and a sufficiently detailed description of the request.

22. Liability

ATD S.R.L. is not liable for delays or failures to perform due to events beyond its reasonable control, including:

• strikes;
• natural disasters;
• transport disruptions;
• orders issued by the authorities;
• sudden unavailability of suppliers;
• widespread breakdowns;
• force majeure events.

Liability that cannot be excluded by law remains unaffected.

23. Privacy

Personal data is processed in accordance with the Privacy Policy published on the website.

Cookie preferences can be changed using the iubenda button available on the website’s pages.

24. Applicable law and competent court

These Terms and Conditions are governed by Italian law.

For disputes with a consumer, the competent court is that of the consumer’s place of residence or domicile, if located in Italy.

For disputes with professionals or businesses, the Court of Naples has exclusive jurisdiction, unless otherwise agreed in writing.

25. Alternative dispute resolution

The consumer may refer to an alternative dispute resolution body registered in the lists provided for by Italian legislation.

It is always possible to apply to the competent judicial authority. ADR procedures make it possible to deal with disputes relating to sales contracts between consumers and businesses.

26. Version of the Terms and Conditions

The applicable Terms and Conditions are those published and accepted at the time the order is sent.

ATD S.R.L. keeps the version applicable to each order and makes it available to the customer in the confirmation email or as a downloadable document.
